Gerneral Terms and Conditions
Area of application
The following terms and conditions (GTC in the following) apply to all contracts closed between the WetterhausConcept GmbH and natural or legal persons (client in the following). The GTC of WetterhausConcept are valid exclusively. Different terms of the client do only apply if their application has not been agreed in writing.
Services
WHC Finance is a service of the WetterhausConcept GmbH (WHC in the following) and includes the brokerage of financing in the areas of factoring, leasing, hire purchase and credit. WHC Finance will contact financial institutions (leasing companies, banks, etc.) on behalf of the client and send their offers to the client. The financing contract is completed by the prospective client directly with the financial institution. The financial institution handles the entire process of the contract and is the contact for the client for everything concerning the contract. The acceptance and the realization of a specific contract may not be influenced by WHC and therefore is not guaranteed.
The financing projects brokered by WHC finance (factoring, leasing, financing) should be standard and contain no or few complications. Otherwise we can also offer the consulting services of WHC Consult for financing projects which are too individual to make use of standard instruments. Costs for consultung however occur only when the client closes a special consulting contract.
Prices
The services offered by WHC aimed exclusively at commercial enterprises, which exist for at least two years. Younger companies or start-ups only in exceptional cases only. WHC Finance receives for the brokerage a fee from the relevant financial institution. Therefore we can offer the WHC Finance services free of charge for the client.
Process time
We process your requests within the shortest possible time, usually the processing time is a maximum of 24 hours for an initially non-binding offer.
Informations about the client
For a final audit of the financing, a certain set of documents about the financial situation of the client's company has to be submitted by the client, depending on the amount of the financing. For individual financing projects, this may be waved off, then the financial partner makes his decisionn based on information provided by banks or information offices (like Creditreform e.g.). The prospective client is responsible for the transmission and in particular for the accuracy of the data / documents provided by him. WHC would like to emphasize that a review of this information does not take place by WHC.
Privacy
Referring to § 33 BDSG, your personal data is stored only in accordance with applicable data protection regulations by us and forwarded to the respective financial institutions. The prospective client agrees that the data (like contact address, financing request, balance sheets, P&L, etc.) provided by him may be forwarded to financial partners in order to process his financing request. Aside this, all data will be kept confidential. Disclosure to third parties, beyond the above form, does not occur.
Liability
We do not guarantee that the relevant information of the clients are correct and that the respective potential financial partner processes the information of the client correctly. In particular, no customer is entitled to free advice from WHC Finance. Requirement for an offer is that the questionnaire provided by the client is completely and truthfully filled out, and any necessary additional data (balance sheets, P & L, etc.) is transmitted by the client.
Miscellaneous
These terms and conditions are subject to German law. If the client is a businessman (acc. To German law), Osnabrück is agreed upon as the exclusive court of jurisdiction for any dispute arising under these terms. If a clause is ineffective in these terms, the remaining clauses shall remain unaffected. The ineffective clause shall be replaced by a valid clause that reflects the intendtion if the invalid clause best. The same applies to possible regulation gaps.
